Filing a takedown notice
If you believe content on HyzerFlip infringes a copyright you own or are authorized to act for, send a written notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the copyrighted work you believe has been infringed (or, for multiple works, a representative list).
- Identification of the material you believe is infringing, with enough information for us to locate it (for example, the league name, team name, and a link or description of the photo).
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
When we receive a valid notice, we will remove or disable access to the material promptly and make a reasonable effort to notify the user who posted it.
Filing a counter-notice
If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which HyzerFlip may be found), and that you will accept service of process from the person who provided the original notice or their agent.
When we receive a valid counter-notice, we will forward it to the person who sent the original notice. We will restore the material in 10 to 14 business days unless that person tells us they have filed a court action seeking to keep the material down.
Repeat infringers
HyzerFlip will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers.
Misrepresentations
Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please consider whether a use may be permitted (for example, as fair use) before sending a notice.
